1. Our Commitment to Intellectual Property Rights

Formcloth respects intellectual property rights, including copyrights, trademarks, service marks, trade names, trade dress, patents, design rights, and other legally protected intellectual property rights. We do not knowingly permit unauthorized use of protected intellectual property on formcloth.com. If you believe material appearing on our website infringes your rights, you may submit a claim using the procedure described below.

2. Who May Submit a Claim

An intellectual property claim may be submitted by the intellectual property rights owner, a person legally authorized to act on behalf of the rights owner, or an authorized attorney/representative. If you are acting for someone else, please include information reasonably demonstrating your authority to submit the claim.

3. Types of Claims We Review

We may review claims involving alleged unauthorized use of product photographs, original artwork, graphics, written content, logos, brand names, trademarks, product designs, marketing materials, copyrighted works, or other legally protected materials appearing on or through formcloth.com.

4. How to Submit an Intellectual Property Claim

To report alleged infringement, contact support@formcloth.com using a clear subject line such as Intellectual Property Claim, including the required information described below.

5. Information Required in a Claim

Please provide:

  • Rights Owner Information: Full legal name, company name if applicable, email address, mailing address, and telephone number if available.
  • Description of the Intellectual Property: Clearly identify the intellectual property you believe is being infringed (copyrighted work, trademark, logo, product image, product design, written content, or other protected material).
  • Proof of Rights: Where reasonably available, provide information demonstrating ownership or authority (copyright registration details, trademark registration number, registration jurisdiction, original publication information, official brand website, licensing documentation, authorization from the rights owner, or other supporting documentation). Registration is not necessarily required where applicable law does not require it, but supporting evidence helps review.

6. Identification of the Allegedly Infringing Material

Please clearly identify the material you believe infringes your rights by providing exact webpage URL, product page URL, product name, screenshot, description of the disputed material, and location of the material on the website.

7. Explanation of the Alleged Infringement

Please explain why you believe the material infringes your intellectual property rights (what right you own, what material allegedly infringes that right, how the material allegedly infringes your right, and whether you have authorized any use of the material), avoiding general statements without identifying specific material.

8. Good-Faith Statement

Your claim should include a statement confirming that you have a good-faith belief that the disputed use is not authorized by the intellectual property owner, the owner's authorized representative, or applicable law.

9. Accuracy Statement

Your claim should confirm that the information you provide is accurate and that you are the intellectual property rights owner or authorized to act on behalf of the rights owner (claims submitted knowingly with false or misleading information may expose the sender to legal responsibility).

10. Signature

Please include your physical or electronic signature (typing your full legal name at the end of an emailed claim may serve as an electronic signature where legally permitted).

11. Claim Review Process

After receiving a sufficiently complete claim, Formcloth may review the information provided, locate the material identified, review available ownership information, request additional documentation if necessary, contact relevant parties where appropriate, restrict/remove/disable disputed material where appropriate, or take other reasonable action based on the circumstances and applicable law (submitting a claim does not automatically guarantee removal of material).

12. Requests for Additional Information

If a claim is incomplete or unclear, we may ask the sender to provide additional information (proof of ownership, authorization documentation, more specific URLs, registration details, screenshots, explanation of claimed rights, or clarification of alleged infringement).

13. Trademark Claims

If you believe content on formcloth.com unlawfully uses your trademark, please include trademark owner name, trademark registration number if available, country or jurisdiction of registration, description of the trademark, goods or services covered by the mark, URL of the allegedly infringing material, and explanation of the alleged unauthorized use, considering factors such as likelihood of confusion regarding source, sponsorship, affiliation, or endorsement.

14. Copyright Claims

If your claim concerns copyrighted material, identify the copyrighted work, original source or publication, allegedly infringing material, relevant URL, your relationship to the copyrighted work, and supporting evidence of ownership or authorization (for claims specifically intended to follow a statutory copyright notice-and-takedown procedure, please also review our separate DMCA Policy where applicable).

15. Product Images and Creative Content

If you believe a product image, graphic, photograph, or written description has been copied without authorization, provide the original work, evidence showing when/where it was published, the disputed Formcloth URL, and a comparison or explanation of the alleged copying.

16. Counterclaims and Disputes

In some circumstances, a person or entity affected by an intellectual property claim may dispute the allegation by submitting evidence, licensing information, ownership documents, or compliance with applicable legal requirements. Formcloth does not act as a court and may not be able to resolve complex ownership disputes, so parties may need to seek independent legal remedies.

17. Removal or Restriction of Content

Where appropriate, Formcloth may remove content, disable access to content, suspend a product listing, modify a listing, request supporting documentation, or take other reasonable corrective action depending on the circumstances and applicable law.

18. Repeat or Serious Infringement

Where appropriate and legally permitted, Formcloth may take additional action in response to repeated, deliberate, or serious infringement, including limiting access to certain content, listings, or services associated with repeated infringement.

19. False, Misleading, or Abusive Claims

Do not submit an intellectual property claim to harass another person, interfere with legitimate competition, make knowingly false statements, claim rights you do not own, misrepresent your legal authority, or improperly remove lawful content. Fraudulent or materially misleading claims may result in rejection of the request and expose the claimant to legal liability.

20. Fair Use and Other Legal Exceptions

Some uses of intellectual property may be lawful under exceptions or limitations provided by applicable law (such as fair use, fair dealing, nominative use, descriptive use, commentary, criticism, or other statutory exceptions).

21. No Admission of Liability

Reviewing, removing, restricting, or retaining disputed material does not necessarily constitute an admission of infringement, an admission of liability, or a legal determination regarding ownership, but rather acts as a practical measure while rights and disputes are evaluated.

22. Rights Reserved

Formcloth reserves the right to request additional information, reject incomplete notices, decline unsupported claims, remove or restrict content, restore content where appropriate, communicate with relevant parties, preserve records relating to a claim, and comply with valid legal requests where permitted by law.

23. Privacy and Intellectual Property Claims

Information submitted as part of an intellectual property complaint may be processed for reviewing the claim, contacting the claimant, investigating alleged infringement, communicating with relevant parties, complying with legal requirements, and maintaining appropriate records, handled otherwise in accordance with our Privacy Policy.

24. Legal Requests

If Formcloth receives a valid court order, subpoena, governmental request, or other legally binding request related to intellectual property, we may respond as required or permitted by applicable law.

25. Independent Legal Advice

This policy describes Formcloth's process for reviewing intellectual property complaints and is not legal advice. If you are uncertain about ownership, infringement, rights under copyright/trademark law, or authorization to submit a claim, you should consider consulting a qualified legal professional.

26. Changes to This Policy

We may update this Intellectual Property Claim Policy when necessary to reflect changes in our website, business operations, intellectual property procedures, or applicable legal requirements by publishing the current version on formcloth.com with an updated revision date.

27. Related Policies
