If you believe copyrighted material is being used on our website without authorization, you may submit a copyright infringement notice as described below.
2. Who May Submit a DMCA Notice
A copyright infringement notice should be submitted by the copyright owner or a person authorized to act on behalf of the copyright owner. If you are acting for another person or organization, you should have appropriate authority to submit the notice on their behalf.

For faster identification, please use an email subject such as: DMCA Copyright Infringement Notice.
4. Required Information in a DMCA Notice
To help us properly review a copyright infringement notice, the notice should include all information required by 17 U.S.C. § 512(c)(3):
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf (an electronic signature may consist of your full legal name where legally sufficient).
- Identification of the Copyrighted Work: Clearly identify the copyrighted work believed to be infringed (or a representative list if multiple works are covered), including title, description, original publication URL, registration information if applicable, and original images or supporting documentation.
- Identification of the Allegedly Infringing Material: Clearly identify the material believed to infringe your copyright with enough information for us to locate it (whenever possible including exact URL, product page URL, product name, screenshot, description, and location on the page).
- Contact Information: Full legal name, company name if applicable, mailing address, telephone number if available, and email address.
- Good-Faith Statement: A statement substantially confirming that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or applicable law.
- Accuracy and Authority Statement: A statement substantially confirming that the information in the notification is accurate and, under penalty of perjury, you are the copyright owner or authorized to act on behalf of the copyright owner.
5. Example Structure of a Copyright Notice
A copyright infringement notice should contain your full name and contact information, identification of the copyrighted work, identification and URL of the allegedly infringing material, an explanation of why you believe the use is unauthorized, your good-faith statement, your accuracy and authority statement under penalty of perjury, and your physical or electronic signature. Incomplete notices may require additional information before we can fully evaluate them.
6. Review of DMCA Notices
After receiving a copyright infringement notice, Formcloth may review the notice for completeness, locate the identified material, evaluate whether the notice contains required information, request additional information where reasonably necessary, remove or restrict access to identified material where appropriate, notify the affected party where required or appropriate, maintain records relating to the complaint, and take other actions permitted or required by applicable law. Submitting a notice does not automatically guarantee removal of content.
7. Incomplete Notices
A notice may be considered incomplete if it does not contain sufficient information to identify the copyrighted work, locate the allegedly infringing material, contact the claimant, verify the claimant's required statements, or determine whether the claimant has signed the notice. If information is missing, we may request clarification before taking further action.
8. Removal or Restriction of Material
After receiving a sufficiently complete copyright notice, Formcloth may remove or disable access to allegedly infringing material where appropriate (such as removing an image or written content, restricting access to a webpage, or temporarily disabling a product listing). Removal or restriction does not necessarily constitute an admission that copyright infringement occurred.
9. Notification to the Affected Party
Where appropriate, we may notify the person or party responsible for the affected material that a copyright complaint was received, material was removed or restricted, a copy or relevant information from the notice may be provided, and a counter-notification process may be available. Information submitted in a DMCA notice may therefore be disclosed to the party associated with the disputed material when necessary to administer the copyright process.
10. DMCA Counter-Notification
If you believe material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification where permitted under applicable law (complying with 17 U.S.C. § 512(g)(3)). Send counter-notifications to Formcloth – Copyright Contact, 497 Winchester Ave, New Haven, CT 06511-1919, United States, Email: support@formcloth.com, using a subject line such as DMCA Counter-Notification.
11. Required Information in a Counter-Notification
A counter-notification should contain the following information:
- Signature: Your physical or electronic signature.
- Identification of Removed Material: Identify the material removed or disabled and where it appeared before removal (URL, product page, description, screenshot if available, and other identifying information).
- Statement Under Penalty of Perjury: A statement substantially confirming that, under penalty of perjury, you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Contact Information: Full legal name, mailing address, telephone number, and email address.
- Consent to Jurisdiction: The applicable statement required by 17 U.S.C. § 512(g)(3) concerning consent to the jurisdiction of the appropriate United States Federal District Court (consenting to the district where your address is located if within the U.S., or where the service provider may be found if outside the U.S.).
- Acceptance of Service: A statement that you will accept service of process from the person who submitted the original infringement notice or an authorized agent.
12. What Happens After a Counter-Notification
If we receive a valid counter-notification, we may send a copy to the person who submitted the original copyright complaint. Subject to applicable law, disputed material may be restored or access restored after the legally applicable period (generally not less than 10 and not more than 14 business days after receipt of a valid counter-notification) unless the original claimant informs us that qualifying court proceedings have been initiated to restrain the allegedly infringing activity.
13. Court Proceedings
If the original claimant initiates appropriate legal proceedings after receiving a counter-notification, the disputed material may remain unavailable while the matter is resolved. Formcloth does not act as a court and does not determine final copyright ownership in complex legal disputes; parties may need to resolve such disputes through appropriate legal process.
14. Repeat Infringement
Where appropriate and in accordance with applicable law, Formcloth may take action concerning parties associated with repeated copyright infringement, including restricting content, removing listings, terminating access to applicable services, refusing content submissions, or taking other reasonable measures.
15. Misrepresentation
Copyright notices and counter-notifications should be submitted carefully and truthfully. Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing or was removed/disabled by mistake or misidentification may be liable for damages and other consequences permitted by law.
16. Fair Use and Other Copyright Exceptions
Before submitting a copyright complaint, consider whether the disputed use may be permitted by applicable law, such as fair use, commentary, criticism, news reporting, education, transformative use, or other legally recognized exceptions.
17. Copyright Ownership Disputes
Formcloth may be unable to resolve disputes involving competing claims of copyright ownership (such as disputed authorship, conflicting licenses, contract disputes, ownership transfers, or joint ownership claims). Where ownership cannot reasonably be determined through the notice process, parties may need to obtain independent legal resolution.
18. Product Images
If you believe a product photograph appearing on formcloth.com infringes your copyright, please identify the original photograph, evidence of authorship or ownership, original publication location, the Formcloth product page containing the image, and the specific image involved.
19. Written Content
Copyright complaints involving product descriptions, articles, marketing text, website copy, guides, or other written material should identify both the original copyrighted material and the specific content alleged to infringe it.
20. Trademarks and Other Intellectual Property
The DMCA primarily addresses copyright claims. Claims concerning trademarks, service marks, trade dress, brand names, design rights, or other intellectual property should generally be submitted according to our Intellectual Property Claim Policy by contacting support@formcloth.com with a clear description of the applicable claim.
21. Information Sharing Related to DMCA Notices
Information contained in a copyright notice or counter-notification may be shared with the party associated with the disputed material, legal advisors, service providers assisting with claim administration, governmental or judicial authorities where required, or other parties where necessary to process or defend a legal claim.
22. Privacy
Personal information submitted through the copyright complaint process may be processed for purposes including reviewing infringement notices, processing counter-notifications, contacting relevant parties, preventing abuse, maintaining legal records, responding to legal proceedings, and complying with applicable laws, handled otherwise in accordance with our Privacy Policy.
23. Fraudulent or Abusive Notices
Formcloth may reject, investigate, or take appropriate action regarding notices that appear to contain knowingly false information, misrepresent ownership/authorization, abuse the copyright complaint process, harass another party, interfere improperly with lawful competition, or seek removal of lawful material without a legitimate basis.
24. No Legal Advice
This DMCA Policy is provided to explain our copyright complaint procedure and does not constitute legal advice. If you are unsure about copyright ownership, infringement, fair use, authorization, or counter-notifications, you should consider consulting a qualified intellectual property attorney.
25. No Admission of Liability
Receiving, reviewing, removing, restricting, restoring, or declining to remove material does not constitute an admission by Formcloth regarding copyright ownership, infringement, liability, validity of a claim, or validity of a defense; actions are taken to administer the applicable notice-and-counter-notice process.
26. Preservation of Rights
Nothing in this policy limits rights, remedies, defenses, or obligations available under applicable copyright law. Copyright owners and affected parties remain responsible for protecting and enforcing their own legal rights.
27. Changes to This DMCA Policy
We may update this DMCA Policy when reasonably necessary to reflect changes in applicable law, copyright procedures, website functionality, business operations, or contact procedures. The current version will be published on formcloth.com with an updated revision date.
